The appellants, aged 59 and 56, had been sentenced to five years of rigorous imprisonment. The defense focused solely on the point of granting the benefit of probation, citing the satisfactory conduct of the convicts since their release on bail in 1993.

Justice Meena, acknowledging the rationale behind the Probation of Offenders Act, stressed its purpose to release offenders on probation of good conduct, promoting reformation and rehabilitation instead of imprisonment. The court found the conviction intact but interfered with the sentencing, ordering the release of the appellants on probation under Section 4 of the Act. The appellants were required to furnish a personal bond and sureties, pledging peace and good behavior for two years.
