Delhi High Court Upholds Divorce Decree on Grounds of Wife’s Conduct

Delhi High Court Upholds Divorce Decree on Grounds of Wife’s Conduct

Introduction:

In a divorce case heard by the Delhi High Court, a husband sought separation on grounds of cruelty by his wife, as per Section 13(1)(ia) of the Hindu Marriage Act, 1955. The court, comprising Justice Suresh Kumar Kait and Justice Neena Bansal Krishna, upheld the family court’s divorce decree, emphasizing the wife’s conduct of attempting suicide and falsely implicating the husband and his family.

Arguments of Both Sides:

The husband alleged cruelty by the wife, citing her desertion of the matrimonial home within four months of marriage, filing false criminal complaints, and subjecting him to civil and criminal litigations. He highlighted her attempts to implicate him in baseless allegations, leading to legal hassles and trauma.

On the contrary, the wife attempted to invalidate her own suicide note, claiming coercion while attempting to put the blame on her husband and in-laws. She argued against the allegations of cruelty, aiming to absolve herself from the accusations levied by her husband.

Court’s Judgement:

The Delhi High Court validated the divorce decree, asserting that the wife’s conduct constituted “extreme cruelty.” The court highlighted the husband’s ordeal due to baseless legal actions initiated by the wife, including false criminal and civil cases, demonstrating a lack of trust and faith in the marriage.

The bench emphasized the wife’s attempt to commit suicide, followed by an effort to shift the blame onto the husband and his family, deeming it a severe act of cruelty. The court noted the wife’s admission, exonerating the husband and in-laws in her suicide note, further strengthening the husband’s stance.

Concluding that the wife’s actions, such as filing false cases and attempting suicide while attempting to blame the husband and his family, constituted cruelty, the court upheld the divorce decree under Section 13(1)(ia) of the Hindu Marriage Act.
