Delhi High Court to Hear Defamation Suit Against Wikipedia by ANI

ANI Media Private Limited has initiated legal action against Wikipedia before the Delhi High Court, alleging defamation over content published on the news agency’s Wikipedia page. The court, under Justice Navin Chawla, has issued notice on ANI’s plea seeking interim relief and scheduled the next hearing for August 20.

Arguments:

Represented by Advocate Sidhanth Kumar, ANI contends that Wikipedia has published defamatory content on its platform. ANI seeks to restrain Wikipedia from further publishing such content and demands the removal of the alleged defamatory remarks. Additionally, ANI has filed a claim for Rs. 2 crores in damages, accusing Wikipedia of tarnishing its reputation with false information.

Wikipedia, represented in the suit by its officials, asserts that the content in question reflects opinions and is not defamatory. They argue that as an intermediary platform, Wikipedia provides a space for public discourse and is protected under the law.

Court’s Judgment:

Justice Chawla, while acknowledging Wikipedia’s right to host opinions, expressed that the case primarily concerns defamation. The court has scheduled further hearings to allow Wikipedia to explain its actions regarding the content in dispute. ANI’s lawsuit against Wikimedia Foundation also accuses them of actively participating in maintaining the allegedly defamatory content.
