Introduction:

Moti Mahal Delux Management Services Private Limited, renowned for its iconic Moti Mahal restaurant chain, has initiated a trademark infringement lawsuit against a restaurant operating under the name “Moti Mahal Delux” in Delhi’s Malcha Marg area of Chanakyapuri. The Delhi High Court, presided over by Justice Amit Bansal, has taken cognizance of the suit, issuing summons and scheduling the matter for hearing on May 21.

Background of the Dispute:

Moti Mahal Delux Management Services Private Limited holds registered trademarks for “MOTI MAHAL,” “MOTI MAHAL GROUP,” “MOTI MAHAL MANAGEMENT SERVICES,” and “TANDOORI TRAIL.” The company alleges that the defendant restaurant’s use of the name “Moti Mahal Delux” constitutes trademark infringement, leading to potential consumer confusion and dilution of their brand identity.

Court Proceedings and Observations:

During the hearing, Justice Bansal noted his familiarity with the Malcha Marg area and acknowledged that the defendant restaurant has been operational for a considerable period. He remarked, “This restaurant is the one in Malcha Marg, it has been running for a long time. Since I am familiar with the area, I know it has been running for a long time…” The judge further emphasized the diplomatic significance of the Malcha Marg locality, suggesting that the restaurant’s longstanding presence in such a prominent area warrants a thorough examination of the basis for its operations under the contested name.

The defendant restaurant, operating as “Moti Mahal Delux” in Malcha Marg, remained unrepresented during the hearing. Given the significance of the dispute, the Court issued summons and directed the defendant to file a written statement in response to the allegations. Additionally, the Court issued a notice on the application seeking an interim injunction to prevent the defendant from using the contested name until the case is resolved.

Previous Legal Actions by Moti Mahal Delux Management Services Pvt. Ltd.

This is not the first instance where Moti Mahal Delux Management Services Pvt. Ltd. has sought legal recourse to protect its trademark rights. In December of the previous year, a coordinate bench of the Delhi High Court had issued a temporary injunction in favor of Moti Mahal Delux Management Services Pvt. Ltd. in a separate case involving trademark and copyright infringement by an ex-franchisee. The Court had restrained SRMJ Business Promoters Pvt. Ltd. from using the impugned marks or any marks deceptively similar to Moti Mahal’s brand for restaurant and catering services.

The Court’s decision in that case reinforced the principle that businesses operating under a franchising model cannot continue using the brand’s name and identity once their association with the parent company ceases. Moti Mahal Delux Management Services Pvt. Ltd. contends that similar legal principles should apply in the current dispute involving the Malcha Marg restaurant.

  • Trademark Violation: The plaintiff claims that “Moti Mahal Delux” is their registered trademark, and any unauthorized use by another restaurant causes confusion among customers and dilutes the brand’s identity.

  • Interim Injunction Request: Given the defendant’s continued use of the name, the plaintiff seeks an interim injunction to immediately stop the defendant from using the brand name while the case is pending.

Court’s Observations and Judgment:

Justice Amit Bansal, while issuing summons, acknowledged that the defendant restaurant had been operational for a significant period, particularly in the prominent Malcha Marg area. However, he maintained that the matter needed proper legal examination. The Court did not immediately grant an interim injunction but directed the defendant to file a written statement in response to the allegations.

The Court emphasized that:

The long-standing presence of the restaurant in Malcha Marg does not automatically validate its use of the name if it infringes on an existing trademark.

Since trademark law protects against unauthorized use, it is essential to assess whether the defendant’s restaurant has a legitimate claim to the name.

If the defendant fails to provide a satisfactory defense, the Court may consider granting an interim injunction.

Justice Bansal scheduled the next hearing for May 21, allowing time for the defendant to respond. The Court’s final ruling will depend on whether the defendant can establish independent rights to the brand name or if Moti Mahal Delux Management Services Pvt. Ltd. can prove the likelihood of consumer confusion and brand dilution.
