In a landmark judgment, the Delhi High Court has declared “Peter England”, an international menswear brand, as a well-known trademark under Section 2(1)(zg) of the Trade Marks Act, 1999. Justice Mini Pushkarna, in her ruling, emphasised that the trademark “PETER ENGLAND” has not only become distinctive but has acquired secondary significance that makes it an identifier for the goods and services of Aditya Birla Fashion and Retail Limited, the company that owns the brand. The Court’s decision comes in the suit filed by Aditya Birla Fashion and Retail Limited, seeking a declaration of its trademark as well-known, strengthening the company’s position in the market.
Arguments:
The company argued that the trademark has become synonymous with their products and services due to extensive advertising and endorsements by prominent public figures like actor Ayushmann Khurrana and the Chennai Super Kings cricket team. These endorsements were widely publicized across major newspapers and journals, further cementing the brand’s recognition.
Judgement:
The Court observed that such significant marketing efforts, along with the brand’s widespread appeal, have made the trademark “PETER ENGLAND” a unique identifier in the marketplace. The brand’s sales turnover for the year 2023-2024 was approximately Rs. 1289 Crores, with Rs. 31 Crores allocated for advertisement and promotional activities. Justice Pushkarna ruled that these factors contributed to the brand’s acquisition of a well-known status, providing it exclusive rights over the trademark. With this ruling, Peter England’s mark now holds enhanced legal protection against infringement, reinforcing its distinctiveness and brand value in the highly competitive menswear industry. The judgment grants the company exclusive rights to use the trademark, further solidifying its presence in the retail and fashion sector. The brand was represented by Mr Ankur Sangal, Partner at Khaitan & Co, along with his team, including MMrAnkit Arvind and Mr. Shashwat Rakshit.
