Adidas AG, represented by counsel Ranjan Narula, Aishani Singh, and Shivangi Kohli, contended that the defendants’ use of ‘ADIDAS’ in relation to textiles caused confusion among consumers, as it mirrored Adidas AG’s well-established brand in the field of readymade garments. They emphasized the identical nature of the marks and the similarity between textiles (the defendants’ products) and garments (Adidas AG’s products), asserting a clear likelihood of consumer confusion.

Defendant’s Argument:

The defendants argued that their adoption of ‘ADIDAS’ was based on personal reasons, stemming from cultural admiration within the Sindhi community, and that their use was in all capital letters, distinguishing it from Adidas AG’s lowercase branding.

Justice Sanjeev Narula of the Delhi High Court dismissed the defendants’ claims, ruling in favor of Adidas AG. The court emphasized that ‘ADIDAS’ is a coined term with no inherent linguistic meaning, enjoying a high degree of distinctiveness and wide protection under trademark law. It noted that both parties operated in closely related sectors, heightening the likelihood of confusion among consumers. The court held that the defendants failed to demonstrate honest adoption of the mark, thereby infringing upon Adidas AG’s trademark rights.
