Delhi HC Upholds Bulletproofing of Vehicles: Rumit Kumar vs. Transport Department

Introduction:

In a recent ruling, the Delhi High Court addressed the issue of bulletproofing vehicles and its implications under the Motor Vehicles Act. The case involved an appeal against the suspension of registration of a petitioner’s car for partial bulletproofing, with the Transport Department arguing the absence of specific rules for such modifications. However, the court’s verdict emphasized the need for a specific finding of danger to the public before suspending vehicle registration, as outlined in Section 53 of the Motor Vehicles Act.

Arguments:

The petitioner’s counsel argued that the suspension order lacked justification and failed to consider the petitioner’s submissions regarding the necessity of bulletproofing. On the other hand, the Transport Department contended that there are no provisions permitting bulletproofing under Section 52 of the Act, leading to the cancellation of the car’s registration.

Court’s Judgement:

Justice Sachin Datta clarified that while Section 52 does not explicitly allow bulletproofing, its absence does not automatically warrant registration suspension unless it poses a danger to the public, as stipulated in Section 53. The court noted the lack of reasoning in the suspension order regarding compliance with Section 53 conditions. Consequently, it quashed the order and instructed the statutory authority to reconsider the matter and provide a reasoned decision.
