Delhi Court’s Scathing Critique of ED’s Use of Power: Upholding Citizen Rights in Legal Proceedings

Delhi Court’s Scathing Critique of ED’s Use of Power: Upholding Citizen Rights in Legal Proceedings

Introduction:

In a recent development, a Delhi court delivered a scathing rebuke to the Enforcement Directorate (ED) for its actions in a money laundering case. Special Judge Vishal Gogne of Rouse Avenue Courts admonished the ED for invoking Section 50 of the Prevention of Money Laundering Act (PMLA) to record statements from private doctors, criticizing the agency’s overreach and disregard for citizen rights.

Arguments of Both Sides:

The defense argued that the ED’s utilization of Section 50 was unwarranted and amounted to a violation of the rights of ordinary citizens, such as the private doctors involved. On the other hand, the ED defended its actions as necessary for the investigation, despite lacking any substantive nexus between the doctors and the allegations against the accused, Amit Katyal.

Court’s Judgment:

The court unequivocally condemned the ED’s actions, emphasizing that as an investigative agency, it is bound by the rule of law and must respect citizen rights. It ruled that Section 50 cannot be used arbitrarily and must be strictly adhered to for collecting evidence related to proceeds of crime. The judge underscored the importance of maintaining a balance of power and restraint in exercising authority, cautioning against authoritarian overreach by government agencies.
