Introduction:
In the case of D Madhumithra v The State and Others, the Madras High Court was faced with a complex custody dispute over a 3-year-old boy. The petitioner, the biological mother, sought the return of her son from the custody of the respondent, arguing that she had never legally relinquished her rights. However, the respondent contended that the child had been given up for adoption due to the mother’s HIV status, and thus, they were the rightful guardians.
Arguments:
The petitioner’s counsel, Mr. Avinash Wadhwani, emphasized that the child was unlawfully withheld from the mother, despite her attempts to regain custody. He argued that since there was no legal adoption process, the respondent’s possession of the child amounted to illegal custody. On the other hand, the respondent’s counsel, Mr. E. Raj Thilak, contended that the child was voluntarily given up for adoption by the mother, citing her HIV status as a reason. He further argued that the pending guardianship petition indicated the ongoing legal process regarding the child’s welfare.
Court’s Judgement:
The court, led by Justice MS Ramesh and Justice Sunder Mohan, prioritized the child’s welfare above all else. Considering that the child had never lived with the petitioner and had been under the care of the respondent since birth, the court deemed it in the child’s best interest to remain in their custody for the time being. However, the court granted the petitioner the right to visit her son once a week and instructed the Principal District Judge to expedite the guardianship petition’s disposal within six months.
