In the case of Adim Jaati Sewa Sahkari Samiti Marayadit Kulhariya v. State of Chhattisgarh and Others (WPC No. 2133 of 2025), the Chhattisgarh High Court addressed the critical issue of delayed paddy lifting from procurement centres. The petitioner, a cooperative society, sought judicial intervention to compel the state to expedite the removal of stored paddy, citing financial strain and potential spoilage due to prolonged storage.

The petitioner contended that the state’s inaction in lifting the procured paddy was arbitrary and detrimental. They emphasised that the delay not only imposed financial burdens due to storage costs but also risked the degradation of paddy quality, leading to potential losses for both society and the public exchequer. State’s Response:

The state acknowledged the delays but attributed them to logistical challenges and natural factors affecting paddy weight. The state emphasised that measures were being taken to mitigate losses and fulfil procurement commitments.

Court’s Judgment:

Justice Amitendra Kishore Prasad observed that the state’s repeated extensions for paddy lifting indicated recognition of the issue’s gravity. The court highlighted the state’s duty to prevent damage to procured paddy, especially considering the impending rainy season and associated risks like climatic conditions and pest infestations. Emphasising the welfare nature of the state, the court directed the authorities to promptly lift the stored paddy after verifying its weight and quality, ensuring receipts are provided to the petitioner. The court clarified that the actual weight at the time of lifting would be considered for all official purposes.
