Central Administrative Tribunal Slams Union Government’s Interference in Staff Appointment: Judicial Independence Compromised

Introduction:

The Central Administrative Tribunal (CAT) recently issued a scathing order, criticizing the Union Government’s objection to the regularization of certain staff appointments made by the Tribunal. The CAT expressed grave concern over the government’s interference in the day-to-day administration of a judicial body, highlighting the potential threat to judicial independence. The case underscores the delicate balance between administrative control and judicial autonomy within the framework of the rule of law.

Arguments of Both Sides:

The applicants, represented by Advocate Yogesh Sharma, sought the regularization of their appointments as Stenographers, emphasizing their uninterrupted service for eleven years and their appointment through a transparent selection process approved by the CAT Chairman. On the other hand, Advocate S.N.
