Calcutta High Court Takes Stern Stand on Tree Cutting During Durga Puja: Imposes Remedial Measures

The Calcutta High Court recently rebuked a Durga Puja Mandal for unauthorized tree cutting to facilitate the construction of temporary structures and light posts during last year’s festivities. Chief Justice TS Sivagnanam and Justice Supratim Bhattacharya directed the Mandal to plant 50 saplings at their own cost in Salt Lake, Kolkata, as a remedial measure. The court emphasized the need for a green cover and imposed a fine, with a stern warning that mere fines wouldn’t suffice.

Arguments of Both Sides:

The petitioner, expressing concern over the unauthorized tree cutting, accused the Puja committee of converting green areas into dry land without proper permissions. The respondents argued that only obstructive branches were pruned, not the entire trees, to enhance Puja lighting. They contended that a complaint was lodged, a hearing conducted, and a fine imposed, indicating accountability.

Court’s Judgment:

The division bench, critical of the committee’s actions, imposed a fine but recognized the inadequacy of financial penalties alone. The court mandated the planting of 50 saplings at the committee’s expense in a court-monitored exercise, emphasizing the personal responsibility of the committee. Chief Justice Sivagnanam stressed the importance of green cover and directed the committee secretary to coordinate with the forest officer for suitable planting spots.
