Balancing Accountability: Bail Granted to Halal Council Officials

Balancing Accountability: Bail Granted to Halal Council Officials

Introduction:

In a significant legal development, the Allahabad High Court granted bail to four office bearers of the Halal Council of India (HCI) accused of issuing fraudulent Halal certificates. The case, Muhammed Tahir Zakir Chauhan vs. State of U.P., underscored the complexities surrounding religious sentiments, commercial practices, and regulatory oversight in the realm of food certification.

Arguments:

The counsels for the accused petitioners argued for bail, highlighting their cooperation with authorities and the ongoing legal challenges to the authority of issuing Halal certificates. They emphasized that the accused were arrested despite providing requested information and before accreditation deadlines elapsed. Conversely, the Additional Advocate General opposed bail, alleging that the trust usurped sovereign functions and disrupted market equilibrium, benefiting certificate recipients at the expense of others.

Court’s Judgement:

Justice Pankaj Bhatia, presiding over the bench, considered the submissions and granted bail to the accused, noting the similarity of allegations with co-accused who were granted interim protection. The Court also took into account the undertaking by the trust to refrain from issuing certificates pending proper authorization. While refraining from delving into the merits of the allegations, the Court deemed bail appropriate given the circumstances.
