Allahabad High Court Imposes Fine and Orders Exam Relief in College Admission Dispute

Introduction:

The Allahabad High Court, in the case of C/M Smt. Vimala Devi Mahavidyalay Bhamai v. State of U.P. and Another, imposed a hefty fine of Rs. 2 Lakhs on the petitioner institution for admitting 60 students into an additional section without completing necessary formalities. However, the Court also intervened to prevent 40 students from suffering due to administrative oversights by directing their participation in an upcoming examination.

Arguments of Both Sides:

The petitioner institution sought to rectify its administrative oversight concerning the admission of 60 students into an additional section, asserting that it had completed admission processes and fee submissions for all students. They highlighted the impending examination, emphasizing that students shouldn’t bear the brunt of administrative shortcomings.

Counsel representing the respondent sought time for instructions and suggested the possibility of supplementary examinations for the 40 affected students.

Court’s Judgment:

The Court observed the cruciality of examinations for students’ future careers and intervened to prevent the 40 students from facing adverse consequences due to administrative errors. While imposing a fine of Rs. 2 Lakhs on the institution for admitting students without fulfilling formalities, the Court directed the respondents to allow the remaining 40 students to partake in the examination. Furthermore, the Court directed the institution to deposit the imposed fine, warning of recovery by the District Magistrate, Prayagraj, in case of non-compliance. The case is scheduled for further hearing on 23rd January, 2023.
