The observations arose during the hearing of a protection plea by a runaway couple seeking protection from the woman’s family, who opposed their marriage.

The petitioners sought protection, claiming they had solemnized their marriage against the wishes of the woman’s family. Justice Moudgil raised concerns about the organization where the marriage occurred, questioning its registration and the authority of those performing rituals. The court highlighted the lack of awareness regarding the authorization of individuals under the Hindu Marriage Act and noted the reuse of marriage props in multiple cases at the same shop.
Court’s Judgement:
Justice Moudgil directed the Assistant Advocate General of Haryana to examine the authority under which the shops in Panchkula operated and facilitated such marriages. The court emphasized the need to adjudicate the matter based on the status report and responses from both parties. Protection was granted until the next hearing, with a police official deployed, the cost to be borne by the petitioners. The case is scheduled for further consideration on March 06.
