Bombay High Court Upholds Regulations for Open and Distance Learning Programs Amidst Challenges from Skill University

The Bombay High Court recently rendered a significant judgment on the constitutional validity of the University Grants Commission (UGC) Regulations, 2020, governing Open and Distance Learning (ODL) and Online Learning (OL) programs. The case involved challenges brought forth by Symbiosis Open Education Society and Symbiosis Skills and Professional University (SSPU) against specific provisions of these regulations.

Arguments:

Symbiosis contended that regulations mandating NAAC accreditation or NIRF ranking for offering ODL and OL programs were unsuitable for skill universities like SSPU. They argued that these criteria did not fairly assess the unique educational models of skill-based institutions.
