Madras High Court Takes Suo Motu Cognizance of Illicit Arrack Manufacture in Kalvarayan Hills, Calls for Comprehensive Socio-Economic Reforms

Introduction:

The Madras High Court, comprising Justice SM Subramaniam and Justice C Kumarappan, has taken suo motu cognizance of a pressing issue in the Kalvarayan hills region. The court noted with concern the rampant manufacture and sale of illicit arrack, driven by poverty and lack of livelihood opportunities among the local population. This prompted the court to initiate proceedings to address the socio-economic plight of the Scheduled Caste and Scheduled Tribe communities residing there.

Arguments:

The court observed the historical neglect of the region, highlighting the absence of essential infrastructure such as schools, hospitals, and employment opportunities. It emphasized that such economic underdevelopment had compelled many to resort to illicit activities for survival. Senior Advocate MR Tamilmani’s insights further underscored the urgency for comprehensive measures to uplift the socio-economic status of the local residents.

Court’s Judgement:

In response, the court directed suo motu proceedings against key governmental authorities at both state and national levels, including the Chief Secretary of Tamil Nadu and the Ministry of Tribal Affairs. The aim is to enforce constitutional mandates ensuring the fundamental rights guaranteed under Article 21, encompassing economic empowerment, health, dignity, and social justice. The court stressed the immediate need for infrastructure development and welfare schemes to prevent further exploitation of vulnerable communities.
