Rajasthan HC: Issues notice to form a special committee to oversee special courts provisioned under POCSO

The Rajasthan HC recently issued notice on a public interest litigation towards the formation of a committee to oversee the condition of Special Courts formed under the Prevention of Children from Sexual Offences act, 2012 (POCSO). The issued this notice in response to a PIL requesting that sex education must be mandatorily provided in all schools and Anganwadi setups of the state. Education and awareness about what constitutes ill-meaning and ill-intended advances of a sexual nature is an important step in eradicating the menace of sexual offenses against oblivious and impressionable minors.

Punjab and Haryana HC: Cannot call persons who did not attend physical classes Engineers

The Punjab and Haryana high court set aside an order of the Haryana Police Housing Corporation (HPHC) to promote an employee to the post of executive engineer on 21 July. The employee had obtained a degree in civil engineering through distance learning. The HC stated, “A person who has not physically attended the classes/course and has not undertaken practical training cannot be said to be an engineer.”

Supreme Court overrules the Delhi HC judgment: Allows woman to abort her 24-week foetus

Allowing the petitioner to suffer an unwanted pregnancy will be contrary to the object and spirit of the legislation, the supreme court said, adding that allowing the petitioner to terminate her pregnancy on proper interpretation of the statute, prima facie, fell within the ambit of the statute.

Lawyers’ petition to the Supreme court claiming State Emblem installed atop Central Vista unconstitutional

Since its inauguration, the Emblem installed atop the Central Vista has equally caught vary sideways glances as well as uproars of appreciation. While many onlookers find the new roaring lions version of the emblem endearing and symbolic of India’s progressive march towards economic and social development, many others find it distasteful, impudent and insulting to the founding beliefs of the country. Two lawyers of the latter belief have moved to the Supreme Court claiming that the statue in question, is illegal and a gross insult to the National Symbol.

While hearing an appeal by a former MSRTC bus conductor against an order directing for the termination of services of the appellant, the Bombay High Court observed, “The approach in this country of believing that when one works for government no action can ever be taken no matter how persistently one is found to be doing wrong is an approach that needs to now stop as fast as possible."

Anti-Ragging Laws in India

Bombay HC: CJ Dipankar Datta recuses hearing plea against CBI Director addressed to CJI NV Ramana

Bombay High Court Chief Justice (CJ) Dipankar Datta on Thursday recused from hearing the petition seeking quashing of the appointment of Subodh Kumar Jaiswal as Director of Central Bureau of Investigation (CBI). CJ Datta said in open court that the petitioner in the case, Rajendrakumar V Trivedi wrote to Chief Justice of India (CJI) NV Ramana complaining about Justice Datta."It seems the petitioner has written a letter to the CJI. It is not in good taste. How do we defend ourselves," the CJ asked.
