Jammu and Kashmir High Court Criticizes Administration for Delayed Release of Detenu

Introduction:

In the case of Muneeb Rasool Shenwari Vs RK Goyal & Ors before the Jammu and Kashmir and Ladakh High Court, the petitioner, Muneeb Rasool Shenwari, sought redressal for the unreasonable delay in his release following the quashing of his preventive detention order by the court in December 2023. Despite the court’s ruling, Shenwari remained in custody until his release was secured through court intervention.

Shenwari, represented by his legal counsel, highlighted the loss of 79 days of his life due to his wrongful detainment and pressed for the execution of the court’s release order. The administration, represented by the District Magistrate and SSP Baramulla, faced criticism for the delay in executing the release order.

Court’s Judgement:

Justice Rahul Bharti, presiding over the case, sharply criticized the UT administration for the unwarranted loss of personal liberty suffered by Shenwari and emphasized the need for timely release of detainees following the quashing of preventive detention orders. The court ordered Shenwari’s immediate release and clarified that he retains the right to pursue legal action against officials responsible for his unlawful detention.
