The Delhi High Court recently issued a summons in a trademark infringement suit filed by Tesla Inc. against Tesla Power India Private Limited and its US counterpart. Alleging unauthorized use of its trademark ‘TESLA,’ Tesla sought interim relief from the court. Arguments of Both Sides:
Mr. Chander M. Lall, representing Tesla Inc., argued that the defendants were unlawfully using the ‘TESLA’ trademark, potentially causing confusion among consumers. On the other hand, counsel for the defendants, Ms. Anita Sahani and Mr. Mukesh Vatsa, contended that their business primarily dealt with lead acid batteries and had no intentions to manufacture electric vehicles.
Court’s Judgement:
Justice Anish Dayal issued a summons to Tesla Power India Private Limited and Tesla Power USA LLC, seeking their written statements in response to the allegations of trademark infringement. The court also granted notice on Tesla’s plea for interim relief and scheduled a hearing for further deliberation on May 22. Additionally, the defendants undertook not to use the ‘TESLA’ trademark or associated logos in connection with electric vehicles and agreed to submit a response to the court within three weeks.
