Introduction:
In the case of X v. Y, the Andhra Pradesh High Court addressed the issue of whether filing false criminal complaints by a spouse constitutes mental cruelty under Section 13(1)(ia) of the Hindu Marriage Act, 1955. The Division Bench, comprising Justice Ravi Nath Tilhari and Justice Challa Gunaranjan, upheld the trial court’s decree of divorce granted to the husband, emphasising that unwarranted criminal proceedings causing trauma and humiliation amount to mental cruelty.
Arguments:
Appellant (Wife): The wife contended that the divorce decree was unsustainable as the grounds of cruelty and desertion were not substantiated. She argued that the mere acquittal of the husband and his family in the criminal case under Section 498-A IPC did not imply that the allegations were false or that they amounted to mental cruelty.
Respondent (Husband): The husband argued that the criminal complaint filed by the wife was baseless and intended to harass him and his family. He emphasised that the acquittal in the criminal case demonstrated the falsity of the allegations, which caused immense mental agony and social humiliation, thereby constituting mental cruelty.
Court’s Judgment:
The High Court observed that mental cruelty can be more severe than physical harm, especially when false criminal allegations lead to social stigma and trauma. The Court noted that the husband and his family had to undergo the ordeal of arrest, bail, and trial, which, despite ending in acquittal, caused significant mental distress. The Court held that such actions by the wife amounted to mental cruelty under Section 13(1)(ia) of the Hindu Marriage Act.
Furthermore, the Court acknowledged that the parties had been living separately for 29 years, indicating an irretrievable breakdown of the marriage. The prolonged separation and the wife’s actions led the Court to conclude that the marriage had become a “fiction,” and there was no possibility of reconciliation. Consequently, the Court dismissed the wife’s appeal and upheld the trial court’s decree of divorce.
