In a recent ruling, the Delhi High Court granted a dynamic+ injunction in favor of global entertainment companies, including Netflix, Disney, and Warner Bros, against 26 rogue websites. The injunction aims to protect copyrighted works from unauthorized dissemination on these platforms.
Arguments of Both Sides:
Represented by counsel including Mr. Siddharth Chopra and Ms. Suhasini Raina, the plaintiffs argued that the rogue websites were unlawfully hosting and streaming copyrighted content without authorization. They sought injunctive relief to prevent further infringement and protect their intellectual property rights. On the other hand, the defendants may have contested the allegations, asserting their right to distribute content freely.
Court’s Judgement:
Justice Anish Dayal granted the dynamic+ injunction, recognizing the need to combat the hydra-headed nature of online infringement. The injunction restrains the rogue websites from hosting or streaming copyrighted content and directs the suspension of their domain names. Additionally, the plaintiffs are permitted to implead any mirror or redirect variations of the infringing websites to ensure comprehensive protection of their works. The matter is scheduled for further proceedings on September 12.
