Supreme Court Directs Immediate Action to Address Solid Waste Crisis in Delhi

Introduction:

The Supreme Court has issued a directive to address the pressing issue of untreated solid waste in Delhi and its surrounding areas. Concerned about the environmental impact and citizens’ fundamental rights, the court emphasized the urgency of implementing proper waste management measures. The case, MC Mehta v. Union of India & Ors., underscores the need for immediate action to mitigate pollution and safeguard public health.

Arguments:

Senior Advocate Maneka Guruswamy, representing the Municipal Corporation of Delhi (MCD), informed the court about the timeline for establishing facilities to handle solid waste. The court expressed alarm over the projected increase in waste accumulation and highlighted the gravity of the situation. The Union government was also called upon to present an action plan to address the crisis.

Court’s Judgement:

The Division Bench, comprising Justice Abhay S. Oka and Justice Ujjal Bhuyan, directed the authorities to take immediate measures to prevent further increase in untreated waste until proper processing facilities are in place. Emphasizing the citizens’ right to a pollution-free environment under Article 21 of the Indian Constitution, the court stressed the need for concrete solutions. A meeting of concerned authorities was convened to formulate a strategy, with the court warning of drastic action if necessary.
