High Court Denounces Mother’s Act of Throwing Infant in Courtroom

In a shocking incident before the Shahdol Magistrate, a woman threw her 13-month-old infant on the courtroom floor, followed by hurling a paperweight towards the child’s head. The Madhya Pradesh High Court deemed this conduct as an attempt to murder her own child and refused to quash the FIR against her.

Arguments:

The woman, through her petition, sought to quash the FIR filed against her for attacking her husband. She alleged it to be a counterblast to her own complaint of assault against her husband. The State, represented by the Deputy Government Advocate, opposed the quashing of the FIR, highlighting the seriousness of the charges and the need for legal recourse.

Court’s Judgment:

Justice Gurpal Singh Ahluwalia, presiding over a single-judge bench, opined that the woman’s actions constituted attempted murder. Refusing to adopt a sympathetic view, the court upheld the FIR, citing the gravity of the offenses committed by the woman. It also issued a notice for contempt of court due to her disruptive behavior during proceedings.
