Supreme Court Slaps Heavy Fine for False Section 498A IPC Case: A Landmark Judgment Against Misuse of State Machinery

Introduction:

In a groundbreaking case between a Chartered Accountant husband and his Deputy Superintendent of Police wife, the Supreme Court delivered a significant verdict on the misuse of legal provisions. The case revolved around false allegations of cruelty under Section 498A IPC lodged by the wife’s father at different locations, prompting the court to impose a hefty fine.

Arguments of Both Sides:

The petitioner, represented by counsels Mr. Rishi Malhotra, Mr. Jaydip Pati, and Mr. Utkarsh Singh, contended that the complaints filed in Hisar and Udaipur were based on identical allegations, indicating a misuse of legal provisions and an abuse of official position by the wife and her father.

On the other hand, the respondents, represented by a plethora of counsels including Dr. Manish Singhvi, Ms. Shubhangi Agarwal, and Mr. Apurv Singhvi, argued against quashing the FIR registered at Udaipur, claiming that the Rajasthan Police was unaware of the previous proceedings in Hisar.
