Bombay High Court Clarifies Interplay between IT Act and IPC in Cybercrime Cases

Introduction:

In a significant ruling, the Bombay High Court elucidated the relationship between the Information Technology (IT) Act, 2000, and the Indian Penal Code (IPC) concerning cybercrimes. The court affirmed that while the IT Act addresses specific cyber offences, the IPC can be invoked concurrently if the offences are not adequately covered under the former.

Arguments:

The accused, a former Technical Manager, faced charges under both the IPC and the IT Act for allegedly misusing company data stored on a laptop. The crux of the argument revolved around the applicability of IPC sections alongside provisions of the IT Act.

Court’s Judgement:

The full bench clarified that the IT Act does not fully encompass elements of offences like cheating and criminal breach of trust defined under the IPC. Therefore, if any ingredient of an offence under the IPC is missing in the act punishable under the IT Act, the IPC sections can still be invoked. The court highlighted the importance of considering legislative intent and statutory provisions while interpreting cybercrime laws.
