Supreme Court Orders Sensitization on Victim Identity Protection in POCSO Cases

Introduction:

In a recent ruling, the Supreme Court addressed concerns over the disclosure of a victim’s identity in a POCSO case and called for the sensitization of judicial and police officers in West Bengal. The case, titled UTPAL MANDAL @ UTPAL MONDAL VERSUS THE STATE OF WEST BENGAL & ANR., highlighted the importance of protecting the identity of child victims of sexual offences, as mandated by Section 33(7) of the POCSO Act and Section 228A of the IPC.

Arguments of Both Sides:

The Supreme Court noted that despite legal provisions prohibiting the disclosure of a victim’s identity, the victim’s name was mentioned during the recording of statements under Sections 164 and 161 of the Cr.P.C. The court emphasized the need for strict compliance with these provisions to prevent potential harm to the victim, as outlined in the landmark case of Nipun Saxena v. Union of India.

Court’s Judgment:

Citing Section 33(7) of the POCSO Act and Section 228A of the IPC, the Supreme Court underscored the paramount importance of safeguarding the identity of child victims. The Court called for sensitization programs to ensure compliance with these legal provisions and directed the Registrar General of the High Court of Calcutta to take appropriate action. By issuing this directive, the Court aims to prevent further violations of the rights of child victims and uphold the principles of justice and protection.
