Introduction:
In the case of Jaywant @ Bhau Mukund Bhoir v. State of Maharashtra, the Bombay High Court issued an order directing the Secretary of Health, Government of Maharashtra, and the Commissioner of Police, Thane, to take legal action against a medical officer, Dr. NA Phad, for gross negligence in conducting the postmortem of the deceased, Mohan Bhoir, in a murder case.
Arguments of Both Sides:
The accused, represented by Advocate Nilesh Navale, filed a bail application contending that the post-mortem report failed to specify the cause of death, raising concerns about procedural irregularities and discrepancies in the report prepared by Dr. Phad. On the other hand, the State, represented by APP Ashish Satpute, supported the court’s intervention and urged for appropriate legal action against Dr. Phad for the observed negligence.
Court’s Judgement:
After reviewing the committee’s report highlighting various irregularities, contradictions, and failures on the part of Dr. Phad, the court concluded that the conduct of the medical officer amounted to gross negligence and illegality. Consequently, the court directed the concerned authorities to initiate legal proceedings against Dr. Phad and take cognizance of the report and court’s order. Additionally, the court called for a preliminary report from the Secretary of Health and scheduled the next hearing for April 23, 2024, with the investigating officer’s presence.
