Introduction:
The Punjab & Haryana High Court recently issued notice on a significant plea advocating for the adoption of A4 size paper with printing on both sides instead of legal size paper with single side printing in court filings. The petition, filed by lawyers Vivek Tiwari and Anjali, aims to reduce paper wastage and promote environmental sustainability. The High Court, recognizing the public importance of the issue, has sought responses from relevant authorities, including the High Court itself and the State administrations of Punjab, Haryana, and Chandigarh.
Arguments:
Vivek Tiwari and Anjali, representing the petitioners, argued that the current practice of using legal size paper or foolscap, prevalent in both the High Court and subordinate courts, is environmentally detrimental. They emphasized the thicker nature of legal size paper, requiring more pulp and causing greater harm to trees. The petitioners argue that utilizing A4 size paper with double-sided printing is more practical and eco-friendly, citing technological advancements and the growing digitization of court records. They also pointed out that the consumption of paper is particularly high in writ jurisdiction and highlighted that only a few High Courts in India have yet to transition to double-sided printing.
Court’s Judgement:
The division bench of Acting Chief Justice GS Sandhawalia and Justice Vikas Suri, acknowledging the significance of the matter, issued notice to relevant authorities and impleaded the Punjab & Haryana High Court Bar Association as a respondent. While deferring the matter to April 25, the court directed the High Court through its Registrar General and Registrar (Rules) to file a response. The court’s action reflects a conscientious approach to addressing environmental concerns and promoting sustainable practices within the legal system.
