Delhi High Court: Tarun Tejpal and Aniruddha Bahal to Publish Unconditional Apology in Defamation Case

Delhi High Court: Tarun Tejpal and Aniruddha Bahal to Publish Unconditional Apology in Defamation Case

Introduction:

In a recent development, former Tehelka editor-in-chief Tarun Tejpal and co-founder Aniruddha Bahal informed the Delhi High Court that they will publish an unconditional apology in a national English newspaper, acknowledging that Major General MS Ahluwalia, who filed a defamation case in 2002, neither sought nor accepted any bribery. The case originated from a Tehelka news report depicting Ahluwalia as a “corrupt middleman” in defense deals. Tejpal, Bahal, and Tehelka were directed by a single judge to pay Rs. 2 crores in damages to Ahluwalia. The appellants filed an appeal against this order, and the recent hearing discussed their commitment to apologize and deposit Rs. 10 lakhs each with the court.

Arguments:

Tejpal and Bahal, through their counsel, conveyed their intent to publish an unconditional apology and deposit Rs. 10 lakhs each. The appeal sought reconsideration of the earlier order, emphasizing that the authenticity of the sting operation and recorded conversations was not challenged. The appellants aimed to contest the quantum of damages, citing the impact on their freedom of the press and the absence of malice in the report.

Court’s Judgement:

The Delhi High Court accepted Tejpal and Bahal’s commitment to publish an unconditional apology and deposit money. The court directed them to comply within two weeks and listed the appeal for final disposal in April, focusing on the issue of quantum of damages. The original order held Tehelka, Tejpal, and journalists liable for defamation, noting the serious impact on Ahluwalia’s reputation.
