Jharkhand High Court Corrects Critical Error in Bharatiya Nyaya Sanhita 2023 Publication: Ensuring Accuracy in Legal Interpretation

Introduction:

In a landmark move, the Jharkhand High Court recently took suo motu cognizance of a significant error in the publication of the Bharatiya Nyaya Sanhita (BNS) 2023 by Universal LexisNexis. The error, identified in Section 103(2) of the BNS, involved the omission of the word “similar,” crucially altering the interpretation and application of this legal provision.

Arguments of Both Sides:

The division bench, comprising Justices Subhash Chand and Ananda Sen, emphasized the critical importance of accurate legal publications. They highlighted that such errors can lead to serious implications in the interpretation of laws, potentially causing injustice and confusion among legal professionals, courts, and other stakeholders. The court underscored the significance of the new laws introduced under the Bharatiya Nyaya Sanhita 2023, replacing the foundational legal frameworks of the Indian Penal Code 1860, Code of Criminal Procedure 1973, and Indian Evidence Act 1872, effective from July 1, 2024.

Court’s Judgement:

Upon thorough examination, the court found that the omission of the word “similar” in Section 103(2) of the BNS 2023 by Universal LexisNexis was erroneous and impactful. This omission, the court noted, could potentially lead to incorrect legal interpretations and unjust outcomes in cases involving group offenses based on specified grounds. The bench directed Universal LexisNexis to urgently rectify this error by publishing a corrigendum in national and regional newspapers, ensuring that all copies of the publication reflect the corrected version. Moreover, the court mandated that unsold copies of the erroneous publication should not be further distributed until rectified.
